For a growing number of states, legalized marijuana is either a new reality or an increasingly likely prospect. Community associations need to prepare for the possibility of nuisance claims, disharmony, and general anxieties. Our panel of experts will cover:

  • The common concerns and conflicts that arise when marijuana is legalized and the importance of setting boundaries and communicating with residents about how an association may legally respond.
  • The rules, amendments, and other common remedies that associations enact to protect the common areas and promote community harmony.
  • A look at the long-term effects of legalization from communities that have been dealing with it for over a decade.

Elina Gilbert, Esq., has practiced community association law for 22 years with Altitude Community Law in Lakewood, Colo., with an emphasis on transactional issues such as insurance, document amendments, and real estate matters. Elina is a frequent speaker on both the local and national levels, including for CAI's Community Association Law Seminar, attorney courses through the National Business Institute, national webinars through HOALeader.com, and state classes and webinars through local CAI chapters. Elina was inducted into CAI's College of Community Association Lawyers in 2010.​

Aimee Winegar, CMCA, AMS, LSM, PCAM, has been working in the community management industry since 1987 and is currently managing a large-scale community in northern Maryland. As a volunteer, she has participated in government programs for alternative dispute resolution in which she adjudicated a number of marijuana-related conflicts within condominiums and homeowners associations.
