Electronic Voting Statutes

(rev 8/25/2012)  – Statute 33-1250 C. Notwithstanding any provision in the condominium documents, after termination of the period of declarant control, votes allocated to a unit may not be cast pursuant to a proxy. The association shall provide for votes to be cast in person and by absentee ballot and may provide for voting by some other form of delivery.

Title 33.Property – 33-1802B. Votes cast by absentee ballot or other form of delivery are valid for the purpose of establishing a quorum.

Virtual Meeting Statute

​Arizona commonly permits corporations, associations, and nonprofits to conduct remote and virtual meetings. Remote meetings contingent on an association’s articles of incorporation, charter, or bylaws. If governing documents are silent, remote and virtual meetings are allowed. The Arizona Nonprofit Corporation Law governs nonprofit corporations with regard to corporate structure and procedure. Contact your association’s attorney to see what your community’s options are for virtual meetings based upon your governing documents.

2015 Arizona Revised Statutes Title 10 - Corporations and Associations § 10-708 Participation in shareholders' meeting 10-708. Participation in shareholders' meeting

Unless the articles of incorporation or bylaws provide otherwise, the board of directors may permit any or all shareholders to participate in an annual or special shareholders' meeting by or conduct the meeting through use of any means of communication by which all shareholders participating may simultaneously hear each other during the meeting. If the board of directors in its sole discretion elects to permit participation by such means of communication, the notice of the meeting shall specify how a shareholder may participate in the meeting by such means of communication. The participation may be limited by the board of directors in its sole discretion to specified locations or means of communications. A shareholder participating in a meeting by this means is deemed to be present in person at the meeting.
