SB 398 will create the "Missouri Homeowners' Bill of Rights" that will deliver vital protections to those living in an HOA. Currently, owners of condominium units are protected by the Missouri Uniform Condominium Act; however, there is little to no regulation of homeowners associations. SB 398 would provide a foundation of protections to those living in HOAs. SB 398 would:
Provide for an organizational and power structure of a board;
Provide for transfer of control process from a developer to a board;
Provide for meeting and record requirements;
Strengthen associations financial tools; and
Provide for necessary resale disclosure requirements.
