The Hawaii Sunrise Review on the certification of condo managers has been completed.
Typically, a sunrise report or review takes place when legislation is proposed to regulate professions not previously regulated, or to expand existing regulation. The review process is a systematic one that analyzes whether there is a need for regulation in order to protect the public from potential harm, whether regulation would serve to mitigate potential harm, and whether the public can be adequately protected by other means in a more cost-effective manner.
Hawaii State Auditor Marion M. Higa has recommended against the certification of condominium association managers in Report No. 05-10, December 2005 (http://www.hawaii.gov/auditor/Overviews/2005/05-10 overview.pdf). By way of background, under House Concurrent Resolution No. 204, last year's Legislature had requested a sunrise analysis be conducted in response to a 2003 bill that proposed to regulate condo association managers via a mandatory certification program.
In recommending against such certification, Auditor Higa offered that "... recent recodification of the Condominium Property Law has addressed many condominium management issues ...." In the final paragraph of the sunrise overview, the Auditor states that "... the proposed regulation is not necessary."
