Wayne Hyatt Lecture Series with Dan Abrams
Community associations and attorneys often bear harsh criticism in the media, but community association attorneys face media criticism of both the housing model and the legal industry. Keynote speaker Dan Abrams, chief legal affairs anchor for ABC News and best-selling author, takes us into the minds of the media when they cover legal stories and offers strategies to help us better deal with high-profile issues within the industry and the community association field.

Looking Within to Identify the Unique Opportunities with Existing Clients
Far too often practitioners pass up opportunities to maximize profits from existing clients by providing thorough service. Studies show that it takes significantly more time and money to form relationships with new clients versus generating services and turning them into profits with existing clients. This panel presentation will explore how to gauge the needs of existing clients and identify procedures to ensure that those needs are exceeded and profits maximized.
Jeffrey A. Beaumont, Esq.*, Beaumont Gitlin Tashjian, Woodland Hills, CA; Matt D. Ober, Esq.*, Richardson Harman Ober, Pasadena, CA

Working Effectively with Experts in Construction Defect Claims Investigations
This session addresses the complexity of properly investigating construction defect claims, covering expert retention, contracts and evidence gathering, and discussing the mistakes that can be fatal to a case. It will examine the liabilities attorneys face in retaining experts and how to structure fee agreements to minimize attorney liability. Techniques for gathering evidence will be discussed as well, including chain of custody issues and joint investigations with developers and subcontractors.

Sticks and Stones: Defamation in Community Associations
Defamation claims brought against and on behalf of community associations, board members, unit owners and managers continue to be on the rise. In this interactive session, the presenters will guide you through the maze of legal and practical issues involved in handling defamation actions in the community association arena, including critical theories, remedies and defenses. It is an essential session for practitioners looking for practical tips and creative solutions so defamatory “sticks and stones” will not hurt their community association clients.

The presenters will walk you through an actual community association Chapter 7 bankruptcy case, from filing to the point of dismissal. In addition, you will be introduced to filing options and the issues that arise in community association bankruptcies, both Chapter 7 and Chapter 11.
John D. Morris, Esq., Morris Sperry, Midvale, UT; Quinn A. Sperry, Esq., Morris Sperry, Midvale, UT

Board Confidentiality in a World of Transparency
Boards often struggle with what information can or should be confidential to satisfy their duties as trustees as opposed to the demand of owners that the board be fully transparent in its governance. This session explores the legal obligation of board members to maintain confidentiality, including issues of attorney-client privilege, negotiation of contracts and pending or threatened litigation. What is the role of the association’s attorney when boards or individual board members tread too far from the line dividing confidentiality and transparency?
Jennifer A. Loheac, Esq., Becker & Poliakoff LLP, Morristown, NJ; J. David Ramsey, Esq.*, Becker & Poliakoff LLP, Morristown, NJ

In addition to reviewing individual cases, this session examines emerging trends in association jurisprudence. C. Scott Canady, Tambala Strategy, Alexandria, VA; George E. Nowack Jr., Esq.*, Weissman, Nowack, Curry & Wilco PC, Atlanta, GA; Wilbert Washington II, Esq.*, Chadwick, Washington, Moriarty, Elmore & Bunn PC, Fairfax, VA

Cutting Edge or Bleeding Edge? Maximizing Technology for Associations
Whether conducting electronic meetings, taking minutes on tablets, documenting violations through smart phones, building websites or accepting online payments, advances in technology benefit community association administration and management. They also impact residents, potential purchasers, boards and industry professionals. This session helps attorneys counsel association clients about technology to increase efficiency, accessibility and effectiveness, while proactively addressing legal risks, policies and other considerations.

Based on a true story—an association identifies the need for a multi-million dollar capital repair project. The litigation that followed, brought by a group of dissenting unit owners, and the strategic developments in that lawsuit, will be examined in this session. Discussion points include how to educate the community; arrange for contractors, bids and specifications; obtain and approve financing for special assessments; and enter into contracts.
Michael Feldman, Esq., Feldman & Hickey LLC, Farmington, CT; Matthew N. Perlstein, Esq.*, Perlstein, Sandler & McCracken LLC, Farmington, CT

Collections, The Perfect Storm: How State Laws, Class-Action Lawsuits and Federal Regulations May Undermine Association Finances
This year brought new, large-scale legal threats on the collections front, spurred in part by federal programs to ameliorate the housing crisis. Big banks buying up foreclosed homes are suing associations to avoid paying statutorily required priority liens; aggressive plaintiff’s attorneys are bringing novel and expensive suits against community association lawyers; and state legislators continue to erect barriers for associations seeking to collect past-due assessments. This session addresses how attorneys can navigate a treacherous sea of challenges.

Changes in the Insurance Services Office (ISO) Commercial Property and Liability Forms and Additional Insured Endorsements
Jodi Horne, Fannie Mae - PowerPoint - Additional Materials

In April 2013, the IS0 began introducing changes to commercial property and liability policies and other insured endorsements. The adoption of these changes is left to each state and insurer, but some find their way into most association insurance policies. The ISO changes involving additional insured endorsements can also have a direct and immediate impact on the language an association might use when it enters into contracts with contractors and service providers. All the key changes and endorsements that might involve associations will be discussed in this session, including the use of a vendor qualification packet as a risk-management tool.

Jude Landis, Director, Single Family Credit Risk Policy, Fannie Mae, Washington, DC; Kevin Miller, ARM, Alliant Insurance Services Inc., Newport Beach, CA; Robert Morgan, CPCU, CIRMS, Philadelphia Insurance Companies, Bala Cynwyd, PA and Gary Newman. Moderated by Clifford J. Treese, CPCU, ARM, CIRMS, Association Data Inc., Pleasanton, CA.

Understanding Community Association Commercial Umbrella and Excess Liability Insurance Policies
