CAI's Community Association Law Seminar is brought to you by the
College of Community Association Lawyers (CCAL). The program is developed each year as part of CCAL's commitment to advancing the knowledge and practice of community association law. 

The Law Seminar provides a unique learning opportunity to discuss emerging trends and legislative issues important to the practice of community association law—as well as excellent opportunities for professional networking.   

CIRMS Insurance Masters Program
CCAL members and Community Insurance and Risk Management Specialists (CIRMS) are pleased to bring back the CIRMS Insurance Masters Program, conducted concurrently with the Law Seminar. The program goes beyond the basics of community association insurance to include risk management and legal issues, and the sessions are taught at a “masters” level by community association insurance experts. Space is limited. Registration for the Law Seminar includes the CIRMS Insurance Masters Program.

Optional Half-Day Program
An optional, half-day program will be held on Thursday, Jan. 24, prior to the Law Seminar. Registration for the program, which includes three education sessions, is an additional fee. Program topic and sessions to be confirmed Sept. 2012.

Cancellation Policy: Full refunds will be issued if written cancellation is received by Dec.14, 2012. Cancellations received between Dec.15-28, 2012, are subject to a 50% administrative fee. CAI Suitcasing Policy: CAI has a no-tolerance policy regarding “suitcasing,” which describes the practice by nonexhibiting companies or individuals of soliciting sales or sales leads in the aisles, or in the lobbies, and/or representing their services or soliciting seminar participants including social activities. Nonsponsoring suppliers participating in the seminar as attendees or speakers are prohibited from soliciting business in or after sessions or in the seminar hotel.

Private Party Policy: All hospitality suites and hosted events must be reserved, approved and paid for through CAI. Hospitality suites/hosted events are not permitted during official conference activities. Nonexhibiting suppliers are not permitted to host events at the official hotel during the conference.

Violators of these policies will be ejected from the show, if exhibiting, and charged the tabletop sponsorship rate ($2,100), which must be paid prior to registering as an attendee, exhibitor or sponsor at any future CAI conference or other event.

The Practice and Industry of Community Association Law
For the remaining time, Julie will moderate a panel discussion with four panelists on The Practice & Industry of CA Law. 
Program Description: Experienced CA Lawyers, from both large and small firms and including partners and associates, will provide a panel discussion about the substantive legal issues and the intangibles of practicing community association law. The panelists will discuss the most common legal issues CA lawyers handle on a day-to-day basis, covering topics such as collections, covenant enforcement, contract review and other routine association issues. Panel topics will also include the non-legal aspects of the nature of a community association practice and the dynamics of the community association industry, including working with homeowners, board members and community managers. The goal of this session will be to provide associates and attorneys new to the practice of CA law with real-world, practical advice and practice pointers.

Safety and Security Issues for Associations: Impact of the Trayvon Martin Case and Other Exposures
The Trayvon Martin case highlighted the potential exposure of an association in connection with neighborhood watch programs. This session analyzes the obligations of an association to provide security and protect the safety of its residents, including conflicts between the common law, statutory duty and governing documents; the obligations to warn residents of potential criminal activity and other threats to safety; a homeowner’s ability to take security measures when such action conflicts with the governing documents; the association’s involvement in criminal investigations; civil litigation stemming from failure to provide sufficient security and the impact of related criminal proceedings; the distinction between security obligations in residential versus commercial properties; and typical insurance policy coverage and exclusions that arise with these types of claims.

This interactive session focuses on the most common and difficult ethical challenges in representing community associations, including conflicts of interests in representing master and sub-associations; concurrent representation of individual directors and the association; representing the management company and the association; providing legal opinions on issues where directors are involved; director conflicts of interest; and disclosure and informed consent. To avoid mistakes, practitioners in this area must constantly be aware of areas where ethical issues may arise. This experienced panel provides guidance and practical tips for lawyers and managers.

Reserve Studies: What Is an Adequate Reserve and What Duties Does the Reserve Provider Owe to Your Community?
Reserve studies are increasingly important to homeowner associations to fulfill federal lending guidelines, accounting reviews, seller’s disclosures and statutory funding requirements. Despite such importance, undercapitalization is a growing problem in community associations. This session explains how to understand reserve studies, the duties owed to the association by the reserve provider, the interplay between disclosure and reserves in conversion condominiums and how some states and communities have addressed the undercapitalization problem.

What started out as a smoldering issue—the legality of banning smoking in community associations—has evolved into a hot debate. This session provides a comprehensive review of the legal and practical aspects of smoking issues and explores different legal theories, such as smoking as a nuisance and trespass. Recent legislation regarding smoking in multi-residential units will be reviewed, as well as the practical considerations of adopting smoking bans.

Whether it’s a claim for failure to allow homeowners to attend a meeting, or refusal to permit access to records, or boards engaging in secret meetings, one of the hottest topics in the community association industry is the cry for more transparency. This session discusses various claims against associations based on lack of transparency and liability for same, increased state legislation on transparency issues, why boards feel the need to hide and overcoming that need, and proactive ways for associations to be more transparent.

Cloud Computing to Increase Firm Efficiency
This session features resources to increase efficiency, reduce malpractice and provide better customer service. It explains services available to lawyers and includes real-life examples of firms that have successfully implemented cloud computing into their practices. It also discusses practice management in the cloud, including the ability to access critical information remotely, and the privacy and security issues that accompany the use of this technology. In addition, it gives an overview of e-discovery as it relates to cloud computing, document storage, and litigation, and it touches on the implications of social media in community association law practices, including community websites and the use of social media tools for firm marketing, discovery, juror research and debt collection.

Essentials of Community Association Contracts: From Regular Operations to Capital Projects
Community associations enter into a variety of contracts (e.g., management, maintenance, construction), and there are essential terms that should be included in all contracts. However, each type of contract also has its particular nuances and requirements. This session reviews what associations, managers and attorneys should consider in preparing and entering into these contracts and what they should be wary of, with an emphasis on contracts necessary to implement a capital replacement or improvement project.

The Constitutional Conundrum: The Application of State and Federal Constitutions to Planned Communities and Condominiums
Planned communities and condominiums have gradually taken over many functions previously the domain of local governmental bodies. Courts have reached different conclusions as to whether the constitution is an appropriate document to apply to such private communities. This session covers the different approaches used by state and federal courts on issues such as speech, religion and assembly. It will include a discussion of the Twin Rivers and Mazdabrook cases, in which the New Jersey Supreme Court ruled on the applicability of that state’s constitutional free speech provision to commoninterest communities.

Community Association Financial Risk Management and Insurance
The combined value of all homes within community associations nationwide is approaching $3.6 trillion, and while maintaining the actual structure falls for the most part on the homeowner, protecting home values is also the responsibility of the association. Association governing documents, state statutes, IRS regulations and lender requirements all play significant roles in managing association dollars and assets. Insurance and risk management play equally important roles, not only as the obvious safety net for unplanned catastrophic and smaller losses, but also as a framework for prudent management. This session provides a detailed overview of association financial management, an analysis of insurance and insurance claims, and the standards of care that are part of the best risk management practices.

Securing Security: Insurance, Risk Management and Technology
Community associations have a variety of choices in how best to provide security for residents, employees, contractors and visitors. For many associations, hiring a security firm is the optimal choice. This session details the best practices used and recommended by a national company that specializes in community association security, including professional licensing and training within the security industry and how technology is changing those practices. Just as important, insurance underwriting and claims handling of security issues will be presented within a risk and financial context.

Employment Practices and Practicing Employment: Trends in Risk Management and Insurance
Community associations that have no employees rarely, if ever, see themselves as possible employers. Conversely, associations that do have employees often believe their basic association insurance program will provide the coverages needed for an employment-related claim. Both ends of the spectrum have been proven wrong, as many have sadly learned. This session provides an essential understanding of what types of insurance policies provide the right protection from employment-related claims, with a focus on key employment areas, including wages and hours, harassment and discrimination, and workers’ compensation issues. Also featured are key components of employment risk management as a necessary companion to any community association insurance program.

The Law Seminar submits for CLE credit in 25+ states. In past years, the Law Seminar has qualified for 15-20 hours of CLE credit.

TERMS: Full payment must accompany signed sponsorship application. CAI reserves the right to refuse any sponsorship application or to cancel any prepaid sponsorship it deems appropriate to avoid conflicts of interest. CAI will refund payments for canceled sponsorships if written requests are received by Nov. 30, 2012. CAI “SUITCASING” POLICY: CAI has a no-tolerance policy regarding “suitcasing,” which describes the practice by non-sponsoring companies or individuals soliciting sales or sales leads seminar hotel, and/or representing their services or soliciting seminar participants for conflicting social activities. Non-sponsoring business partners participating in the seminar as attendees or speakers are prohibited from soliciting business in or after sessions, or in the seminar hotel.

PRIVATE PARTY POLICY: All hospitality suites and hosted events must be reserved, approved and paid for through CAI. Hospitality suites/hosted events are not permitted during official seminar activities. Non-exhibiting suppliers are not permitted to host events at the official hotel during the seminar.

Violators of these policies will be ejected from the Conference if applicable, and charged $2,100, which must be paid prior to registering as an attendee, exhibitor, or sponsor at any future CAI events.
